Minutes of Executive Committee
of November 27, 2002

The meeting began at 2:42 pm.

John Kirk reported on grievances. The main one is the situation at Canada where an instructor was placed on 'administrative leave.' There is no such thing as 'administrative leave' and we have filed an unfair labor practice. PERB will hold a hearing in early January.

Ernie Rodriguez stated that, in a time of budget crisis, it was odd that Canada was paying a number of faculty to perform non-teaching tasks.

Katharine Harer reported on negotiations. We are tyring to agree on what is part time parity. The District says it does not need to pay part timers for office hours because years ago they put money in the contract to cover this. We disagree and have asked the mediator from last year's negotiations to meet with the two of us.

We then discussed a letter from Richard Holober to Rick Ambrose in which he discussed the situation regarding the Ron Galatolo and the State Chancellors office. Baiscally the State Chancellor had offered two deals: a) Galatolo stays on until his contract expires and then an open hiring process is carried out and b) the district pays a fine of $300,000 over three years and Galatolo can stay on for as long as he likes. The Board of Trustees had rejected both as punitive and will ask the court to enjoin the State Chancellor from withholding any funds from the District until this matter is settled.

After extensive discussion on what position the union should take regarding this issue, which has many facets, some of which, such as the legality of the actual hiring process, we did not feel we were equipped to judge, John Kirk made a motion, which was seconded by Chip Chandler, that focused on three points. After the last two points were added as friendly admenents, the motion below was passed unanimously:

AFT Local 1493 supports the following positions:

1. There should always be faculty involvement in the hiring of educational administrators.

2. AFT Local 1493 supports the Resolution adopted by the Skyline Academic Senate and presented to the Board of Trustees on Nov. 20, 2002.

3. The SMCCCD Board of Trustees should not file suit or take any other legal action against the State Chancellor and/or the Board of Governors.

4. The SMCCCD Board of Trustees should accept, from the State Chancellor's Office, the best compromise settlement offer which does not include a financial penalty levied against the District.

5. The State Board of Governors and the District should continue to work toward a settlement of this dispute.

Finally, the EC unanimously passed the resolution entitled "Health Care For All" which will be submitted by Local 1493 for consideration at the March CFT Convention in San Francisco.
